DEFECT LIABILITY PERIOD AND COMPENSATION. If at any time during six (6) calendar months from the date of completion of work it shall appear to the Addl. SE/Sr. Executive Engineer or his subordinate in-charge of the work that any work has been executed with unsound, imperfect or unskillful workmanship or with material of inferior quality or that any materials or articles provided by him for the execution of work are unsound or of a quality inferior to that contracted for or are otherwise not in accordance with the contract, it shall be lawful for Xxxx.XX/Xx. Executive Engineer to intimate this fact in writing to the contractor and then notwithstanding the fact that the work materials or articles complained of may have been inadvertently passed, certified and paid for, the contractor shall be bound forthwith to rectify, or remove or re-construct the work so specified in whole or in part as the case may require or if so required shall remove the materials or articles at his own charge and cost, and in the event of his failing to do so within a period to be specified by the Addl. SE/Sr.Executive Engineer in the written intimation aforesaid the contractor shall be liable to pay compensation at the rate of half(1/2) percent on the amount of the work executed for every day not exceeding ten days during which the failure so continues and in the event of any such failure as aforesaid the Xxxx.XX/Xx.Xxxxxxxxx Engineer may rectify or remove and re-execute the work or remove and replace the materials or articles complained of as the case may be, at the risk and expense in all respects of the contractor. Should the Xxxx.XX/Xx. Executive Engineer feel that any such inferior work or materials as described above may be accepted or made use of , it shall be within his discretion to accept the same at such reduced rates as he may fix thereof.

  • Defect Liability Period The defect liability period (if any) shall be as per Special Conditions of Contract of Part-B.

  • Employer Liability 45.1 The Employer shall indemnify and save harmless all Employees from legal liability and all actions, causes of action, claims or demands whatsoever arising out of any occurrence occurring during the course of or performed pursuant to and within the scope of their employment, save and except in the case of gross negligence or wilful misconduct, provided timely notice is given to the Employer of any occurrence giving rise or likely to give rise to a claim against a member of the Employer.

  • ’ Compensation/Employer’s Liability Insurance If Contractor has employees, it shall maintain workers’ compensation insurance as required by law. Employer’s liability limits shall be not less than $1,000,000 for each accident, $1,000,000 as the aggregate disease policy limit, and $1,000,000 as the disease limit for each employee. If Contractor does not have employees, it shall provide a letter, on company letterhead, to the Judicial Council certifying, under penalty of perjury, that it does not have employees. Upon the Judicial Council’s receipt of the letter, Contractor shall not be required to maintain workers’ compensation insurance.

  • Our Liability to You 8.1 We will not be liable to You in respect of any losses You or the Card User may suffer in connection with or arising from the Card, except where such losses are due to a breach by us of this Agreement or due to Our negligence.   • Extension of Defects Liability Period The Defects Liability Period shall be deemed to be extended till the identified Defects under Clause 17.2 have been remedied or rectified.
