The term Classified Information means information that is classified as Restricted Data or Formerly Restricted Data under the Atomic Energy Act of 1954, or information determined to require protection against unauthorized disclosure under Executive Order 12958, Classified National Security Information, as amended, or prior executive orders, which is identified as National Security Information.

The term Classified Information means For the purpose of this Agreement, classified information is defined as information that is classified as Restricted Data generated by or Formerly Restricted Data for the Government of the United States of America or the Government of Australia or that is under the Atomic Energy Act jurisdiction or control of 1954one of them, and which requires protection in the interests of national security of that government and that is so designated by the assignment of a security classification by that government. The information may be in oral, visual, electronic, or information determined to require protection against unauthorized disclosure under Executive Order 12958, Classified National Security Information, as amendeddocumentary form, or prior executive ordersin the form of material including, which is identified as National Security Informationequipment or technology.
