Common use of Definition of Parties Clause in Contracts

Definition of Parties. ‌ This agreement entered into by and between Xxxxxxxxx Education Association, hereinafter called "Association", as presently constituted, and the School District of Xxxxxxxxx, the County of Pierce, Washington, hereinafter called "District" or "Board." The signatories shall be the sole parties to this agreement. PART 1 - DISTRICT / ASSOCIATION RELATIONSHIPS ARTICLE I - RECOGNITION‌‌‌ Recognition: The District hereby recognizes the Association as the sole and exclusive bargain representative for all contracted certificated personnel, excluding administrators whether on leave, employed or to be employed by the Board. Such representation shall cover all personnel assigned to newly created professional positions unless the parties agree in advance that such positions are principally supervisory and administrative. The term "certificated employee" when used hereinafter in the Agreement shall refer to all employees represented by the Association in the bargaining unit as above defined. Substitute employees are covered by this agreement after working 20 consecutive days or 30 cumulative days in the current school year. Substitute pay will be reviewed annually and set by the Board, but will not be less than the current rate per day. After a substitute works more than 20 consecutive days and continues to work in the same position, the substitute will be paid their appropriate salary schedule placement, retroactive to the first day in the assignment. The only other sections of this CBA that will apply to subs are the following: Article I, II, III, V, VI Article VII--Sections 7, 8, and 14 Article XXX--Xxxxxxxx 0, 0, xxx 0 Xxx Xxxxxxxx agrees not to negotiate with or recognize any certificated employee organization other than the Association for the duration of this Agreement.
