Common use of Delay in Submission of Deliverables Clause in Contracts

Delay in Submission of Deliverables. Subject to the terms set forth in Section 4.12, if the Design-Builder fails to provide any of the deliverables set forth in Exhibit C, the Design-Builder shall pay to the Department liquidated damages in the amount set forth in the Project Information Section of this Agreement for each such deliverable that is not timely submitted.
