Common use of DELAYED ACCEPTANCE Clause in Contracts

DELAYED ACCEPTANCE. If for any reason the Buyer is unable to accept delivery of the Goods when the Goods are due and ready for delivery, the Supplier may arrange storage of the Goods at the Buyer's risk and the Buyer shall be liable to the Supplier for the reasonable costs (including insurance) of such storage. This provision is without prejudice to any other right which the Supplier may have in respect of the Buyer's failure to take delivery of the Goods or pay for them in accordance with the Contract.

If for any reason the Buyer Customer is unable to accept delivery of the Goods goods when the Goods goods are due and ready for delivery, delivery the Supplier Company may (but shall not be under any obligation to) arrange storage of the Goods at the Buyer's risk goods and the Buyer Customer shall be liable to the Supplier Company for the reasonable costs (including insurance) of such storage. This provision is without prejudice to any other right which the Supplier Company may have in respect of the Buyer's Customer’s failure to take delivery of the Goods goods or to pay for them in accordance with the Contractcontract when payment would have been due if the goods had been delivered when due and ready for delivery.
