Common use of Delays in Commissioning Clause in Contracts

Delays in Commissioning. 12.3.1.1 If the Plant has not been Commissioned on or before the Required Commercial Operations Date, the Seller shall pay to the Purchaser an equivalent amount to the Energy charge that the Purchaser would require in order to source for an alternative source of energy for that delayed period. 12.3.1.2 Payments made in accordance with Clause Error!
