Joint Occupational Health and Safety Committee. The Employer and the Union recognize the role of the joint Occupational Health and Safety Committee in promoting a safe and healthful workplace. The parties agree that a Joint Occupational Health and Safety Committee shall be established for each Employer covered by this Collective Agreement. The Committee shall govern itself in accordance with the provisions of the Industrial Health and Safety Regulations made pursuant to the Workers’ Compensation Act. The Committee shall be as between the Employer and the Union, with equal representation, and with each party appointing its own representatives. Representatives of the Union shall be chosen by the Union membership or appointed by the Union. All minutes of the meetings of the Joint Occupational Health & Safety Committee will be recorded in a mutually agreeable format and will be sent to the Union. The Union further agrees to actively pursue with the other Health Care Unions a Joint Union Committee for the purposes of this Article. The Employer agrees to provide or cause to be provided to Employer members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfil those duties competently. The Union agrees to provide or cause to be provided to Union members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfil those duties competently. Such training and orientation shall take place within six (6) months of taking office.
Joint Occupational Health and Safety Committee. The Hospital will recognize one (1) bargaining unit employee of the Joint Occupational Health and Safety Committee. When a regular member of the Committee is not available, she or he may be replaced by an alternate, appointed by the Association.
Joint Occupational Health and Safety Committee. The Corporation and the Union agree that Health and Safety of all employees is important in preventing accidents, injury and illness.
i) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the Home, in order to prevent accident/injury and illness and abide by the Occupational Health and Safety Act as amended from time to time.
ii) As a member of the Joint Occupational Health and Safety Committee the parties will have input in creating solutions to promote health and safety in the Home. The Home will ensure adequate stocks of PPE (example N95 respirators), in case of a pandemic outbreak.
iii) The Joint Occupational Health and Safety Committee shall be established which is composed of an equal number of Employees (one ONA representative) and Employer Representatives. The committee shall normally meet every three months or more frequently if the committee decides for jointly monitoring, inspecting, investigating and reviewing health and safety conditions and practices Minutes shall be taken of all meetings and copies shall be sent to the Employer and the Association. Minutes of the meetings shall be posted on the workplace health & safety bulletin board. The responsibility for chairing meetings and for Minutes shall be determined by the Committee. Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programmes and recommend actions to be taken to improve conditions related to safety and health. The parties agree that if actions by aggressive residents result in injury to an Employee, and/or lead to the filing of an Incident Report, such Report will be provided to the Joint Occupational – Health and Safety Committee for review. The Committee’s review will respect the confidentiality and rights of the resident(s) and Employee(s). The JOH&S Representative attending Safety Committee meetings shall be paid at her regular rate of pay. Also, time spent on behalf of the committee will be as per the Occupational Health and Safety Act.
iv) The Employer agrees to accept as a member of its Joint Occupational Health and Safety Committee at least one (1) ONA representative who is trained to be a certified worker representative selected or appointed by the Union from the Employer. Scheduled time spent in obtaining the workers certification by the JOH&S representative of ONA shall be paid by the Employer at the nurses regular rate of pay.

(b) Recognizing its responsibilities under the applicable legislation, OPTIONS agrees to accept as a member of its Joint Occupational Health and Safety Committee, at least one (1) representative selected or appointed by the Union from amongst bargaining unit employees.
(c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health.
(d) OPTIONS agrees to cooperate reasonably in providing necessary information to enable the Committee to fulfill its functions. In addition, OPTIONS will provide the Committee with reasonable access to all accident reports, health and safety records and any other pertinent information in its possession.
(e) Meetings shall be held at least once every three (3) months or more frequently at the call of the Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review.
(f) Any representative appointed or selected in accordance with (b) hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. Time off for representative(s) to perform these duties, shall be granted. A member of a committee is entitled to,
(i) one (1) hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting;
(ii) such time as is necessary to attend meetings of the committee; and
(iii) such time as is necessary to carry out (inspections and investigations under subsection 9 (26), 9 (27), and 9 (31) of the Act.) ref: Occupational Health and Safety Act. Sec. 9 (34). A member of a committee shall be deemed to be at work during the times described {above} and the member’s employer shall pay the member for those times at the member’s regular or premium rate as may be proper. ref: Occupational Health and Safety Act. (g) The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices.
(h) All time spent by a member of the Joint Occupational Health and Safety Committee attending meetings of the Committee and carrying out her duties, shall be deemed to be work time for which she shall be paid by OPTIONS at her regular rate and she shall be entitled to such...

(b) Recognizing its responsibilities under the applicable legislation, the Hospital agrees to accept as a member of its Joint Occupational Health and Safety Committee, at least one (1) representative selected or appointed by the Association from amongst bargaining unit employees. Hospitals with sites of up to one hundred (100) nurses per site may choose to include a representative from the bargaining unit from each site, or have a separate Joint Occupational Health and Safety Committee at each site or to remain with the current structure. Hospitals with sites of over one hundred (100) nurses per site will choose either to include a representative from the bargaining unit from each site, or to have a separate Joint Occupational Health and Safety Committee at each site, unless the parties agree otherwise.

(f) Where the committee alters the required frequency of meetings by its rules of procedure and the Director of Occupational Health and Safety Division of the Nova Scotia Department of Labour (hereinafter in this Article referred to as the “Director”) is not satisfied that the frequency of meetings is sufficient to enable the committee to effectively perform its functions, the frequency of the meetings shall be as determined by the Director.
(g) An Employee who is a member of the committee is entitled to such time off from work as is necessary to attend meetings of the committee, to take any training prescribed by the regulations and to carry out the Employee's functions as a member of the committee, and such time off is deemed to be work time for which the Employee shall be paid by the Employer at the applicable rate.
(h) The committee shall establish its own rules of procedure and shall adhere to the applicable regulations.
(i) Unless the committee determines another arrangement for chairing the committee in its rules of procedure, two of the members of the committee shall co-chair the committee, one of whom shall be selected by the members who represent Employees and the other of whom shall be selected by the other members.
(j) The rules of procedure established pursuant to Article 31.03(h) shall include an annual determination of the method of selecting the person or persons who shall:
(i) chair the committee; and
(ii) hold the position of the chair for the coming year.
(k) Where agreement is not reached on:
(i) the size of the committee;

Joint Occupational Health and Safety Committee. The parties agree that the intent of this article is to ensure that all employees shall have the maximum possible access to the Occupational Health and Safety Committee structure.
(a) A joint health and safety committee will be established and will function pursuant to the regulations of the Workers Compensation Act, with equitable union representation.
(b) Union representatives shall be employees at the workplace appointed by the Union, and employer representatives shall be appointed by the Employer.
(c) The Union's representatives on the Committee shall be paid their applicable straight-time rate of pay for all time spent at committee meetings or other approved work of the Committee. There shall be an equal number of employer and union employees on the Committee. If either party desires more than four representatives, the Employer and the Union will agree on the number.
(d) The Committee shall meet in person or virtually. The Employer will provide a room/virtual space.
(e) Minutes of all committee meetings will be kept and copies posted on the safety bulletin board. Copies of the minutes will also be distributed to the Labour/Management Committee.
(f) The Committee shall:
(1) carry out regular safety inspections as required by the Workers' Compensation Board Regulations;
(2) carry out accident investigations as required by the Workers' Compensation Board Regulations;
(3) recommend measures to attain compliance with Workers' Compensation Board Regulations and the correction of hazardous conditions;
(4) determine that the structures, equipment, machinery, tools, methods of operation and work practice are in accordance with the Workers' Compensation Board Regulations;
(5) consider recommendations from the workforce and/or the Employer in respect to industrial health and safety matters and recommend their implementation to the Employer, where warranted;
(6) hold regular meetings in accordance with Section (a) for the review of:
(i) reports of current accidents or industrial diseases, their causes and means of prevention;
(ii) remedial action taken or required by the reports of investigations and inspections; and
(iii) any other matters pertinent to industrial health and safety.
