Joint Occupational Health and Safety Committee. The Employer and the Union recognize the role of the joint Occupational Health and Safety Committee in promoting a safe and healthful workplace. The parties agree that a Joint Occupational Health and Safety Committee shall be established for each Employer covered by this Collective Agreement. The Committee shall govern itself in accordance with the provisions of the Industrial Health and Safety Regulations made pursuant to the Workers’ Compensation Act. The Committee shall be as between the Employer and the Union, with equal representation, and with each party appointing its own representatives. Representatives of the Union shall be chosen by the Union membership or appointed by the Union. All minutes of the meetings of the Joint Occupational Health & Safety Committee will be recorded in a mutually agreeable format and will be sent to the Union. The Union further agrees to actively pursue with the other Health Care Unions a Joint Union Committee for the purposes of this Article. The Employer agrees to provide or cause to be provided to Employer members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfil those duties competently. The Union agrees to provide or cause to be provided to Union members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfil those duties competently. Such training and orientation shall take place within six (6) months of taking office.
Joint Occupational Health and Safety Committee. (a) The Home and the Association agree that they mutually desire to maintain standards of safety and health in the home in order to prevent accidents, injury and illness and abide by the Occupational Health and Safety Act as amended from time to time.
(b) Recognizing its responsibilities under the applicable legislation, the Home agrees to accept as a member of its Joint Occupational Health and Safety Committee, at least one (1) representative selected or appointed by the Association from amongst bargaining unit employees.
(c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health.
(d) The Home agrees to cooperate reasonably in providing necessary information to enable the Committee to fulfill its functions. In addition, the Home will provide the Committee with reasonable access to all accident reports, health and safety records and any other pertinent information in its possession.
(e) Meetings shall be held every second [2nd] month or more frequently at the call of the Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review.
(f) Any representative appointed or selected in accordance with (b) hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. Time off for such representative(s) to attend meetings of the Joint Occupational Health and Safety Committee in accordance with the foregoing, shall be granted and any representative(s) attending such meetings during their regularly scheduled hours of work, shall not lose regular earnings as a result of such attendance. A representative shall be deemed to be at work during the times described above and the Home shall pay the representative for those times at the representative’s regular or premium rate as may be proper.
(g) The Association agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices.
(h) All time spent by a member of the Joint Occupational Health and Safety Committee attending meetings of the Committee and carrying out her duties, shall be deemed to be work time for which she shall be paid by the Home at her regular rate or premium rate as may be proper and she shall be entitled to such time from work as is necessary to attend scheduled meetings.

Joint Occupational Health and Safety Committee. The Hospital will recognize one (1) bargaining unit employee of the Joint Occupational Health and Safety Committee. When a regular member of the Committee is not available, she or he may be replaced by an alternate, appointed by the Association.

Hospital with sites of up to one hundred (100) nurses per site may choose to include a representative from the bargaining unit from each site, or have a separate Joint Occupational Health and Safety committee at each site or to remain with the current structure. Hospitals with sites of over one hundred (100) nurses per site will choose either to include a representative from the bargaining unit from each site, or to have a separate Joint Occupational Health and Safety Committee at each site, unless the parties agree otherwise.

(e) The committee shall meet at least once each month unless:
(i) a different frequency is prescribed by the regulation; or
(ii) the committee alters the required frequency of meetings in its rules of procedure.
(f) Where the committee alters the required frequency of meetings by its rules of procedure and the Director of Occupational Health and Safety Division of the Nova Scotia Department of Labour (hereinafter in this Article referred to as the “Director”) is not satisfied that the frequency of meetings is sufficient to enable the committee to effectively perform its functions, the frequency of the meetings shall be as determined by the Director.
(g) An Employee who is a member of the committee is entitled to such time off from work as is necessary to attend meetings of the committee, to take any training prescribed by the regulations and to carry out the Employee's functions as a member of the committee, and such time off is deemed to be work time for which the Employee shall be paid by the Employer at the applicable rate.
(h) The committee shall establish its own rules of procedure and shall adhere to the applicable regulations.
(i) Unless the committee determines another arrangement for chairing the committee in its rules of procedure, two of the members of the committee shall co-chair the committee, one of whom shall be selected by the members who represent Employees and the other of whom shall be selected by the other members.
(j) The rules of procedure established pursuant to Article 31.03(h) shall include an annual determination of the method of selecting the person or persons who shall:
(i) chair the committee; and
(ii) hold the position of the chair for the coming year.

Joint Occupational Health and Safety Committee. (a) The Employer and the Union agree to recognize the Joint Health and Safety Committees and the right of the committees to represent the nurses in all matters dealing with Health and Safety subject to the Occupational Health and Safety Act of Ontario 1990 RSO.
(b) The Employer shall take all precautions reasonable in the circumstances for the protection of workers. All rights and privileges, duties and standards established under the laws of the Province of Ontario in respect of Occupational Health and Safety shall form part of this Agreement.
(c) The Union endeavours to obtain the full cooperation of its membership in observation of all safety rules and practices.
(d) The Employer shall ensure that a worker uses or wears the equipment, protective devices or clothing that the Employer requires to be used or worn and take every precaution reasonable in the circumstances for the protection of a worker.
Joint Occupational Health and Safety Committee. A) The parties agree that the intent of this Agreement is to ensure that all employees shall have access to the Occupational Health and Safety Committee structure. Joint Occupational Health and Safety Committees will be established and operated as outlined below:
i) Union representatives shall be employees at the workplace appointed by the Union, the Employer representatives shall be appointed by the Employer.
ii) The committee will function in accordance with the WorkSafeBC requirements and Occupational Health and Safety Regulation and will participate in developing a program to reduce risk of occupational injury and illness. All minutes of the meetings of the committee shall be recorded on a mutually agreed to form and shall be sent to the Union and the Employer.
iii) Employees who are representatives of the committee shall not suffer any loss of basic pay for the time attending a committee meeting.
iv) Committee meetings shall be scheduled during normal working hours whenever practicable. Time spent by designated committee members attending meetings held on their days of rest or outside their regularly scheduled hours of work shall not be considered time worked, but such committee members shall receive cash or equivalent time off at straight time.
B) The Employer shall save harmless and indemnify any employee from claims that may arise from the administration of medication as covered by the Comprehensive General Liability Insurance Provisions of the Provincial School Protection Plan.
