Common use of Delegation by the Employer’s Engineer Clause in Contracts

Delegation by the Employer’s Engineer. 18.3.1 The Employer’s Engineer may, by order in writing, delegate any of his duties and responsibilities to suitably qualified and experienced personnel who are accountable to Employer’s Engineer, or may revoke any such delegation, under intimation to the Employer/PMNC and the Contractor. Provided, however, that the Employer’s Engineer shall be responsible and liable for all actions and omissions of such personnel. 18.3.2 Any failure of the Employer’s Engineer to disapprove any work, Plant or Materials shall not constitute approval, and shall therefore not prejudice the right of the Employer to reject the work, Plant or Materials, which is not in accordance with the provisions of this Agreement and the Specifications and Standards. 18.3.3 Notwithstanding anything stated in Clause 18.3.1 above, the Employer’s Engineer shall not delegate the authority to refer any matter for the Employer’s/PMNC prior approval wherever required in accordance with the provisions of Clause 18.2.
