Deletion of Section 5. 4(f). Section 5.4(f) of the Merger Agreement is hereby deleted in its entirety.
Deletion of Section 5. 07. Section 5.07 of the Agreement is hereby deleted in its entirety and said section shall be intentionally left blank.
Deletion of Section 5. 09. Section 5.09 of the Original Trust Indenture is hereby deleted in its entirety.
Deletion of Section 5. 1.17. Each of Section 5.1.17 of the Credit Agreement and each reference thereto in the Credit Agreement is hereby deleted in its entirety.
Deletion of Section 5. 9. Section 5.9 of the Amended Restructuring Agreement will be of no further force and effect.
Deletion of Section 5. 40. Section 5.40 to the Credit Agreement is hereby deleted in its entirety.
Deletion of Section 5. 21. Section 5.21 of the Agreement is hereby deleted.
Deletion of Section 5. 2. Section 5.2 of the Indenture hereby is amended by deleting such Section in its entirety and substituting therefor the words "[Intentionally omitted]."
Deletion of Section 5. 15. Section 5.15 of the Merger Agreement is hereby deleted in its entirety and shall have no further force or effect.
