Common use of Delivery by Buyer Clause in Contracts

Delivery by Buyer. If this Agreement is canceled for any reason, except Seller's willful default hereunder, Buyer agrees to deliver to Seller upon payment by Seller to Buyer of Buyer's cost thereof, copies of those investigations, studies and/or tests which Buyer may have elected to obtain.

Delivery by Buyer. If this Agreement is canceled for any reason, except Seller's ’s willful default hereunder, Buyer agrees to deliver to Seller upon payment by Seller to Buyer of Buyer's ’s cost thereof, copies of those investigations, studies and/or tests which Buyer may have elected to obtain.

If this Agreement is canceled as to all of the Premises for any reason, except Seller's willful default hereunder, Buyer agrees to deliver to Seller upon payment by Seller to Buyer of Buyer's cost thereof, copies of those investigations, studies and/or tests which Buyer may have elected to obtain.

If this Agreement is canceled for any reason, except Seller's ’s willful default hereunder, Buyer agrees to deliver to Seller all diligence materials delivered by Seller to Buyer and, upon payment by Seller to Buyer of Buyer's ’s cost thereof, copies of those investigations, studies and/or tests which Buyer may have elected to obtain.

If this Agreement is canceled as to all Properties for any reason, except Seller's ’s willful default hereunder, Buyer agrees to deliver to Seller upon payment by Seller to Buyer of Buyer's ’s cost thereof, copies of those investigations, studies and/or tests which Buyer may have elected to obtain.

If this Agreement is canceled as to all Properties for any reason, except Seller's ’s willful default hereunder, Buyer agrees to deliver to Seller upon payment by Seller to Buyer of one-half Buyer's ’s reasonable and actual out-of-pocket cost thereof, copies of those investigations, studies and/or tests which Buyer may have elected to obtain.

Delivery by Buyer. If this Agreement is canceled for any reason, except Seller's ’s willful default hereunder, Buyer agrees to deliver to Seller, upon written request from Seller upon and payment by Seller to Buyer of one-half of Buyer's ’s reasonable and actual cost thereofof the item requested, copies of any or all of those investigations, studies and/or tests which Buyer may have elected to obtain.

Delivery by Buyer. If this Agreement is canceled for any reason, except Seller's ’s willful default hereunder, Buyer agrees to deliver to Seller upon payment by Seller to Buyer Seller, free of Buyer's cost thereofcharge, copies of those investigations, studies and/or tests which Buyer may have elected to obtain.

If this Agreement is canceled for any reason, except Seller's willful default hereunder, Buyer agrees to (i) deliver to Seller Seller, upon payment by Seller to Buyer of Buyer's cost thereof, copies of those investigations, studies and/or tests which Buyer may have elected to obtainobtain and (ii) deliver to Seller, at no cost to Seller, Seller's Diligence Materials provided to Buyer.

If this Agreement is canceled for any reason, except Seller's willful default hereunder, Buyer agrees to deliver to Seller upon payment by Seller to Buyer of Buyer's cost thereof, copies of those investigations, studies and/or tests which Buyer may have elected to obtain and which Seller wishes to obtain.

If this Agreement is canceled as to all of the Properties for any reason, except Seller's ’s willful default hereunder, Buyer agrees to deliver to Seller upon payment by Seller to Buyer of Buyer's cost thereof, copies of those any additional investigations, studies and/or or tests which Buyer may have elected to obtain.

If this Agreement is canceled for any reason, except Seller's willful default hereunder, Buyer agrees to deliver to Seller (i) all Seller's Diligence Materials received by Buyer from Seller, and (ii) upon payment by Seller to Buyer of Buyer's cost thereof, copies of those investigations, studies and/or tests which Buyer may have elected to obtain.

If this Agreement is canceled for any reason, except Seller's willful default hereunder, Buyer agrees to deliver to Seller upon payment by Seller to Buyer of Buyer's cost thereof, copies of those investigations, studies and/or tests Studies which Buyer may have elected to obtain.
