Common use of Delivery of a Utilisation Request Clause in Contracts

Delivery of a Utilisation Request. The Company may utilise the Facility by delivery to the Agent of a duly completed Utilisation Request not later than 11.00 a.m. three (3) Business Days prior to the proposed Utilisation Date or by such date as the Agent (acting on the instructions of all the Lenders) may agree with the Company.

Delivery of a Utilisation Request. The Company Borrower may utilise the a Facility by delivery to the Agent of a duly completed Utilisation Request not later than 11.00 10:00 a.m. three (3) on the day falling 3 Business Days prior to before the proposed Utilisation Date or by such date as (or, in relation to the Agent (acting first Utilisation Request, not later than 10:00 a.m. on the instructions of all day falling 2 Business Days before the Lenders) may agree with the Companyproposed Utilisation Date).

The A Borrower (or the Company on its behalf) may utilise the a Facility by delivery to the Agent of a duly completed Utilisation Request not later than 11.00 a.m. three (3) the Specified Time, provided that, in case it intends to deliver a Utilisation Request with less than 3 Business Days prior Days’ notice, it has given notice to the Agent no later than the Specified Time indicating the proposed Utilisation Date or by such date as the Agent (acting on the instructions of all the Lenders) may agree with the CompanyDate.
