Common use of Delivery of a Utilisation Request Clause in Contracts

Delivery of a Utilisation Request. A Borrower (or the Obligors’ Agent on its behalf) may utilise a Facility by delivery to the Facility Agent of a duly completed Utilisation Request (and in the case of a Documentary Credit, delivery of such Utilisation Request to both the Facility Agent and the relevant L/C Bank) not later than the Specified Time or by not later than the time specified in the relevant Additional Facility Accession Agreement.

Delivery of a Utilisation Request. A Borrower (or the Obligors’ Agent on its behalf) may utilise a Facility by delivery delivery: (a) to the Facility Agent (with a copy to the Collateral Management Agent) (in respect of Facility A and/or Facility B); and (b) to the relevant Facility C Lender, with a copy to the Collateral Management Agent (in respect of Facility C), of a duly completed Utilisation Request (and in the case of a Documentary Credit, delivery of such Utilisation Request to both the Facility Agent and the relevant L/C Bank) not later than the Specified Time or by not later than the time specified in the relevant Additional Facility Accession AgreementTime.

Delivery of a Utilisation Request. A Borrower (or the Obligors’ Agent Original Borrower on its behalf) may utilise a Facility during the Availability Period by delivery to the Facility Agent of a duly completed Utilisation Request (and in the case of a Documentary Credit, delivery of such Utilisation Request to both the Facility Agent and the relevant L/C Bank) by not later than the Specified Time in relation to the proposed Utilisation Date (or by not later than such other time as may be agreed to in writing between the time specified in Facility Agent (acting on the relevant Additional Facility Accession Agreementinstruction of all Lenders under a Facility) and the Borrower).

A Borrower (or the Obligors’ Agent on its behalf) may utilise a Facility by delivery to the Facility Agent of a duly completed Utilisation Request (and in the case of a Documentary Credit, delivery of such Utilisation Request to both the Facility Agent and the relevant L/C 00000000_9 Bank) not later than the Specified Time or by not later than the time specified in the relevant Additional Facility Accession Agreement.
