Common use of Delivery of Aircraft to LESSEE Clause in Contracts

Delivery of Aircraft to LESSEE. Subject to Lessee having complied with the conditions set out in Clause 4.2, or the waiver thereof by Lessor, Lessor will deliver the Aircraft to Lessee at the Delivery Location. Provided that the Aircraft is in the condition required by Clause 4.2, upon the tender of the Aircraft by Lessor to Lessee, Lessee will accept the Aircraft and the date of tender by Lessor to Lessee will be deemed to be the Delivery Date for all purposes under this Agreement, including, but not limited to, the commencement of Lessee's obligation to pay Rent hereunder. Lessee shall execute and deliver the Acceptance Certificate to Lessor on the Delivery Date.

Delivery of Aircraft to LESSEE. Subject to Lessee having complied with satisfied all of the conditions precedent to Delivery set out in Clause 4.2, forth herein or the waiver thereof of any of the same by Lessor in Lessor’s discretion, Lessor will deliver tender the Aircraft for Delivery to Lessee on the Delivery Date at the Delivery Location. Provided that the Aircraft is in the condition required by Clause 4.2, upon Upon the tender of the Aircraft by Lessor to Lessee, Lessee will accept the Aircraft and deliver to Lessor the Acceptance Certificate, duly executed. The date of tender by Lessor to Lessee in accordance with this Lease will be deemed to be the Delivery Date for all purposes under this AgreementLease, including, but not limited to, the commencement of Lessee's ’s obligation to pay Rent hereunder. Lessee shall execute and deliver the Acceptance Certificate to Lessor on the Delivery Date.
