Common use of Demand Response, Efficiency and Affordability Programs Clause in Contracts

Demand Response, Efficiency and Affordability Programs. The 2009 Rate Case will also include the amortization related to the Demand Response, Efficiency and Affordability Programs, as more fully described in Paragraph III.B.5 below. The Signatory Parties agree not to contest the continuation of this amortization in the 2009 Rate Case on any basis other than KCPL’s failure to prudently implement the Demand Response, Efficiency and Affordability Programs described in Paragraph III.B.5 below.
