DEMONSTRATION AUTHORITY. ‌ The following is a summary of the terms and conditions the parties intend to incorporate into the Three-way Contracts, as well as those activities the Parties intend to conduct prior to entering into the three way contracts and initiating the Demonstration. This section and any appendices referenced herein are not intended to create contractual or other legal rights between the Parties and the Demonstration Plans.

DEMONSTRATION AUTHORITY. Under the authority at section 1115A of the Social Security Act (“Act”), the Center for Medicare and Medicaid Innovation is authorized to “…test payment and service delivery models …to determine the effect of applying such models under [Medicare and Medicaid].” Such models include but are not limited to the models described in section 1115A(b)(2)(B) of the Act. Section 1115A(d)(1) authorizes the Secretary to waive such requirements of titles XI and XVIII of the Act and of Sections 1902(a)(1), 1902(a)(13), and 1903(m)(2)(A)(iii) of the Act as may be necessary solely for purposes of testing models described in section 1115A(b).

DEMONSTRATION AUTHORITY. Medicare Authority: The Medicare elements of the initiative shall operate according to existing Medicare Parts C and D laws and regulations, as amended or modified, except to the extent these requirements are waived or modified as provided for in Appendix 5. As a term and condition of the Demonstration, MSHO Plans included in this Demonstration will be required by CMS to comply with Medicare Advantage and Medicare Prescription Drug Program requirements in Part C and Part D of Title XVIII of the Social Security Act, and 42 CFR Parts 422 and 423; and applicable sub-regulatory guidance, as amended from time to time, except to the extent specified in this MOU, including Appendix 5; and for waivers of sub-regulatory guidance other approved CMS documents.
