Demonstration of Commercial Operation. In order for the NYGATS certificates associated with the Bid Facility to be flagged with Tier 1 RES eligibility, the associated energy must be delivered into the NYCA in accordance with the delivery requirements specified in the Clean Energy Standard Final Phase 1 Implementation Plan and the NYGATS Operating Rules.
