Notwithstanding any reviews, approvals, criticisms or modifications given by the Town or its consultants, neither the Town, the Director nor the Town’s Consulting Engineer shall in any way be responsible for the design drawings or the plans and specifications related to these Works and the Owner shall bear sole responsibility for the soundness of the engineering design and for ensuring that the works required to be done will function as intended and contemplated.

The Developer, at its own cost and expense, shall retain qualified engineers registered in the Commonwealth of Pennsylvania to prepare the necessary plans and specifications for the construction and installation of the Extended Facilities and for the connection of those Extended Facilities with the Authority’s . The Developer shall coordinate the design of the Extended Facilities with the Authority and shall obtain the Authority’s written approval of the design and the specifications in accordance with the requirements of Exhibit “A” attached hereto and incorporated herein. All to be constructed by the Developer shall be designed in accordance with all applicable federal, state and municipal laws, ordinances, and regulations and the Authority’s minimum standards for design and construction of .

If HBG reviews design drawings, specifications, construction drawings or workshop drawings or any other documents prepared by or on behalf of the Supplier, gives any approval, direction, or instruction to the Supplier, or provides information to the Supplier, this shall not relieve or reduce the Supplier's sole responsibility for the supply of the Goods and performance of the Services in accordance with the Contract, nor release the Supplier from its obligations under clauses 6 and 7, and shall not restrict HBG's rights and remedies under the Contract or constitute acceptance by HBG that the Supplier has complied with its obligations under the Contract.
Design and Specifications. The design and specifications for the Project shall be provided by ENGINEERING FIRM, hereinafter referred to as the "Design Consultant", and shall be responsible for the following scope of work:

If this Agreement specifies that the Seller will be manufacturing certain Goods for purchase by the Buyer, the Goods shall be manufactured in accordance with specifications provided by the Buyer, or provided by the Seller and approved by the Buyer (the “Specifications”), as the case may be.
6. If the Buyer requests changes to the Specifications after the date of this Agreement, the Seller may increase the price of the Goods.
7. The Seller is not responsible for ensuring that any Goods or Services are suitable for the premises or location in which the Goods will be installed (whether or not such installation is performed by the Seller) or in which the Services will be provided. Without limiting the generality of the foregoing, it is the Buyer’s responsibility to ensure that all grounds, roads, floors and structures (together with any vehicles and equipment used by the Seller or its agents to transport and install the Goods) are sufficient to support the weight of the Goods and that the Goods will fit through entryways into the Buyer’s premises. Unless otherwise stated in the Quotation or a Work Order, structural changes required to be made to Buyer’s premises are not included.
8. Goods incorporate only the electrical components referred to in the Specifications unless otherwise specified in the Quotation or a Work Order. Buyer will be responsible for the cost of all electric wiring and fittings. Charges arising from any local, provincial, or other governmental laws and regulations necessitating changes to electrical equipment are at extra cost unless equipment has been specifically quoted to comply with such laws or regulations. Mainline disconnects for multi-monitored machines are not included in the Quotation or Work Order unless specified therein. Seller will not be liable for any damage, loss or expense caused by voltage drop or change or insufficiency of power supply.
Design and Specifications. CPSC shall proceed promptly and with due --------------------------- diligence to prepare the engineering design and specifications of the Pipelines, Transfer Terminal and the Facilities in order to comply with the Operating Requirements. CPSC shall complete and provide POC with a copy of such design in accordance with Exhibit "B", which POC shall expeditiously review. CPSC shall receive POC's written approval of such design of the Pipelines, Transfer Terminal and the Facilities prior to commencement of construction. Such design, which may be subsequently altered, will be described in words and mapped and shall become Exhibit "A".
