Common use of Design Professional’s Liability Insurance Clause in Contracts

Design Professional’s Liability Insurance. 9.1.1 Design Professional will maintain the following limits and coverages uninterrupted or amended through the life of this Contract. In the event the Design Professional becomes in default of the following requirements, the Owner reserves the right to take whatever actions deemed necessary to protect its interest. Required liability and property insurance policies, other than Workers' Compensation/Employer's Liability and Professional Liability, will provide that the Owner, members of the Owner's governing body, and the Owner's officers, volunteers, agents, volunteers and employees are included as additional insureds. Design Professional shall require that all subcontractors and subconsultants maintain insurance meeting all the requirements stated herein with the sole exception that Design Professional shall determine the applicable limits for its subcontractors and subconsultants. Design Professional shall have subcontractors and subconsultants endorse all applicable policies to name the Owner, members of the Owner’s governing body, and the Owner’s officers, agents, volunteers and employees as Additional Insureds. Before subcontractor or subconsultant commences services under this Contract, Design Professional will submit evidence that the subcontractor or subconsultant has complied with this provision to Owner.
