Common use of Destruction by Common Safekeeper Clause in Contracts

Destruction by Common Safekeeper. may instruct the Common Safekeeper to destroy, upon disposal authorisation from the ICSDs, each NGN Temporary Global Note and NGN Permanent Global Note in accordance with Clause 4.12 (Exchange of Temporary Global Note) or Clause 7.1 (Payments by Paying Agents) in which case, upon receipt of confirmation of destruction from the Common Safekeeper, the Fiscal Agent shall furnish the Issuer with a copy of such confirmation (provided that, if the Fiscal Agent is the Common Safekeeper, the Fiscal Agent shall destroy each NGN Temporary Global Note and NGN Permanent Global Note in accordance with Clause 4.12 (Exchange of Temporary Global Note), 4.13 (Exchange of Permanent Global Note) or Clause 7.1 (Payments by Paying Agents) and furnish the Issuer with confirmation of such destruction); and

Destruction by Common Safekeeper. may instruct the Common Safekeeper to destroy, upon disposal authorisation from the ICSDs, destroy each NGN Temporary Global Note and NGN Permanent Global Note, or a Global Registered Note to be held under the NSS in accordance with Clause 4.12 4.11 (Exchange of Temporary Global Note) or Clause 7.1 8.1 (Payments by Paying Agents) in which case, upon receipt of confirmation of destruction from the Common Safekeeper, the Fiscal Agent shall furnish the Issuer with a copy of such confirmation (provided that, if the Fiscal Agent is the Common Safekeeper, the Fiscal Agent shall destroy each NGN Temporary Global Note and NGN Permanent Global Note in accordance with Clause 4.12 4.11 (Exchange of Temporary Global Note), 4.13 (Exchange of Permanent Global Note) or Clause 7.1 8.1 (Payments by Paying Agents) and furnish the Issuer with confirmation of such destruction); and

Destruction by Common Safekeeper. may instruct the Common Safekeeper to destroy, upon disposal authorisation from the ICSDs, destroy each NGN Temporary Global Note and NGN Permanent Global Note in accordance with Clause 4.12 5.11 (Issuance of Notes – Exchange of Temporary Global Note) or Clause 7.1 9.1 (Payments to Noteholders – Payments by Paying Agents) in which case, upon receipt of confirmation of destruction from the Common Safekeeper, the Fiscal Agent shall furnish the Issuer and the Guarantors with a copy of such confirmation (provided that, if the Fiscal Agent is the Common Safekeeper, the Fiscal Agent shall destroy each NGN Temporary Global Note and NGN Permanent Global Note in accordance with Clause 4.12 5.11 (Issuance of Notes – Exchange of Temporary Global Note), 4.13 (Exchange of Permanent Global Note) or Clause 7.1 9.1 (Payments to Noteholders – Payments by Paying Agents) and furnish the Issuer and the Guarantors with confirmation of such destruction); and

Destruction by Common Safekeeper. may instruct the Common Safekeeper to destroy, upon disposal authorisation from the ICSDs, destroy each NGN Temporary Global Note and NGN Permanent Global Note in accordance with Clause 4.12 3.11 (Exchange of Temporary Global Note) or Clause 7.1 6.1 (Payments by Paying Agents) in which case, upon receipt of confirmation of destruction from the Common Safekeeper, the Fiscal Principal Paying Agent shall furnish the Issuer with a copy of such confirmation (provided that, if the Fiscal Principal Paying Agent is the Common Safekeeper, the Fiscal Principal Paying Agent shall destroy each NGN Temporary Global Note and NGN Permanent Global Note in accordance with Clause 4.12 3.11 (Exchange of Temporary Global Note), 4.13 (Exchange of Permanent Global Note) or Clause 7.1 6.1 (Payments by Paying Agents) and furnish the Issuer with confirmation of such destruction); and

Destruction by Common Safekeeper. may instruct the Common Safekeeper to destroy, upon disposal authorisation from the ICSDs, destroy each NGN Temporary Global Note and Note, NGN Permanent Global Note or a Global Certificate to be held under the NSS in accordance with Clause 4.12 3.10 (Exchange of Temporary Global Note) or Clause 7.1 (Payments by Paying Agents) in which case, upon receipt of confirmation of destruction from the Common Safekeeper, the Fiscal Principal Paying Agent shall upon written request furnish the Issuer with a copy of such confirmation (provided that, if the Fiscal Principal Paying Agent is the Common Safekeeper, the Fiscal Principal Paying Agent shall destroy each NGN Temporary Global Note and NGN Permanent Global Note in accordance with Clause 4.12 3.10 (Exchange of Temporary Global Note), 4.13 (Exchange of Permanent Global Note) or Clause 7.1 (Payments by Paying Agents) and upon written request furnish the Issuer with confirmation of such destruction); and

Destruction by Common Safekeeper. may instruct the Common Safekeeper to destroy, upon disposal authorisation from the ICSDs, destroy each NGN Temporary Global Note and NGN Permanent Global Note, or a Global Registered Note to be held under the NSS in accordance with Clause 4.12 3.10 (Exchange of Temporary Global Note) or Clause 7.1 (Payments by Paying Agents) in which case, upon receipt of confirmation of destruction from the Common Safekeeper, the Fiscal Principal Paying Agent shall furnish shall, upon request, confirm destruction to the Issuer with a copy of such confirmation (provided that, if the Fiscal Principal Paying Agent is the Common Safekeeper, the Fiscal Principal Paying Agent shall destroy each NGN Temporary Global Note and NGN Permanent Global Note in accordance with Clause 4.12 3.10 (Exchange of Temporary Global Note), 4.13 (Exchange of Permanent Global Note) or Clause 7.1 (Payments by Paying Agents) and and, upon request, furnish the Issuer with confirmation of such destruction); and
