Common use of Destruction or Return of Customer Data Clause in Contracts

Destruction or Return of Customer Data. On the applicable Governmental Entity’s written request or upon expiration or termination of this Agreement or applicable Purchasing Instrument for any reason, Vendor will promptly: 10.1.2.1. After providing notice to the applicable Governmental Entity and subject to its prior written approval, return or destroy, at the applicable Governmental Entity’s option, Customer Data; and 10.1.2.2. Provide a notarized written statement to the applicable Governmental Entity certifying all Customer Data has been returned or destroyed to the Governmental Entity, whichever is applicable. To the extent Vendor is required to destroy Customer Data pursuant to this Section, Customer Data shall be permanently deleted and shall not be recoverable, in accordance with National Institute of Standards and Technology (“NIST”)-approved methods.
