Performance incentives and disincentives for Overall Diversion Level, Minimum Single-Family Diversion Level, Minimum Commercial Diversion Level, Contamination, Average Speed of Answer and Ninety (90) Second Maximum Hold Time shall be calculated in aggregate for the SBWMA Service Area and Agency’s share shall be proportional based on the tons of Solid Waste Collected by Contractor for Rate Year One (2011) by Previous Contractor. Performance incentives and disincentives for Single-Family Missed Pick-Up Initial Complaints and Single-Family Missed Pick-Up Collection Events shall be calculated separately for each Agency.

As required by 3417 Section 7.07, Contractor shall report: (i) the addresses of any Premises at which the 3418 driver observes that Solid Waste, Targeted Recyclable Materials, and/or Organic 3419 Materials is accumulating; and (ii) the address, or other location description, at 3420 which Solid Waste, Targeted Recyclable Materials, and/or Organic Materials has 3421 been dumped in an apparently unauthorized manner. The report shall be delivered 3422 to the Agency within one (1) Business Day of such observation. 3423 B. Hazardous Waste. As required by Section 8.07, the Contractor shall notify the 3424 Agency of any Hazardous Waste identified in Containers or left at any Premises 3425 within twenty-four (24) hours of identification of such material. 3426 C. Reporting Adverse Information. Contractor shall provide Agency two (2) copies 3427 (one (1) to the Agency Manager, one (1) to the Agency Attorney) of all reports, 3428 pleadings, applications, notifications, Notices of Violation, communications or other 3429 material relating specifically to Contractor’s performance of services pursuant to this 3430 Agreement, submitted by Contractor to, or received by Contractor from, the United 3431 States or California Environmental Protection Agency, the California Integrated 3432 Waste Management Board, the Securities and Exchange Commission or any other 3433 federal, State, County, or local agency, including any federal or State court. Copies 3434 shall be submitted to Agency simultaneously with Contractor’s filing or submission 3435 of such matters with said agencies. Contractor’s routine correspondence to said 3436 agencies need not be submitted to Agency, but shall be made available to Agency 3437 promptly upon Agency’s share written request. 3438 9.09 UPON-REQUEST REPORTING 3439 A. Holiday Tree Services.
