Common use of Determination of ARR Clause in Contracts

Determination of ARR. (a) The ARR that will apply in each Financial Year be calculated based on: (1) the ARR and principles set out by the QCA in its Final Decision on the Xxxxxxxxx Bay Coal Terminal Draft Access Undertaking dated [insert] (as amended by the QCA prior to the Commencement Date, if so amended); and (2) any amendment to the Access Undertaking, the ARR, Revenue Cap or Reference Tariff made pursuant to clause 6(a).
