Common use of Determination of Illness or Incapacity Clause in Contracts

Determination of Illness or Incapacity. For purposes of this Article VI, the term “illness or incapacity” shall mean Employee’s inability to perform Employee’s duties hereunder, substantially on a full-time basis because of physical or mental illness or physical injury as determined by the Company’s Board of Directors, in its reasonable discretion and based upon competent medical evidence. Upon CareView’s written request, Employee shall submit to reasonable medical and other examinations to provide the evidence required hereunder.
