Determination of Superintendent. Should the Superintendent determine, after consulting with the school principal, that it is in the best interest of the District to recommend a teacher for transfer pursuant to Florida Statute 1012.27(4), the Superintendent shall, unless an emergency transfer is required, provide twenty (20) working days written notice to the teacher of the intent to transfer. The teacher may, within five (5) working days of the receipt of said notice, request in writing a meeting with the superintendent to set forth the teacher’s objection to said transfer. Said meeting shall occur within ten (10) working days of the teacher’s request being submitted to the Superintendent. The employee shall be allowed to have a representative from the Association attend said meeting. After meeting with the teacher, if the Superintendent still desires to recommend transfer, the Superintendent shall notify the teacher of such final recommendation, in writing, which writing shall state the specific reason for the recommended transfer. Thereafter, the recommended transfer will be subject to the School Board’s final approval as set forth in Florida Statute 1012.22 (1) (e).”
