TRANSFER OF TEACHERS. (a) The parties acknowledge that priority placements of displaced teachers are the paramount consideration in this Article.
(b) At the earliest possible date the Board, in consultation with the Union, shall seek alternatives for the teachers on the priority placement list.
21.2 The Board shall make all reasonable best efforts to fill vacant and unfilled administrative positions on or before May 7th of each year.
21.3 Only permanent contract teachers and teachers on the priority placement list are eligible for transfer pursuant to the provisions of subsection 21.4 – 21.7 of this Article
21.4 In order to encourage and promote voluntary teacher transfer, the Board shall:
(a) by May 1st but in no event later than May 7th, compile a list of all vacant and unfilled (one year) positions available for the following school year. In the event that the Board is unable to complete its staffing requirements by May 1st, but in no event later than May 7th, then an alternate schedule of posting may be mutually agreed upon by the parties; and
(b) continue to publish a list of positions to include any new positions created by the transfer of teachers or as a result of any administrative appointment or any other position that becomes available. The Board shall carry out two rounds of voluntary transfers. The positions shall be posted for four (4) calendar days.
21.5 Voluntary transfers shall not commence until all teachers have been given their teaching assignments.
(a) Teachers shall apply in writing to request a transfer to a specific position(s) and shall be offered a position on the basis of seniority provided they are competent and qualified by training and/or experience for the position. Notwithstanding Article 21.20, a teacher holding a permanent contract who applies for multiple positions may rank the positions in order of preference and shall be offered the highest ranked position based on seniority, for which they would be competent and qualified to receive.
(b) Unsuccessful applicants for voluntary transfer may request an explanation of the successful applicant choice.
(c) Notwithstanding Article 21.6 (a), but following the close of the competition for each of the two (2) voluntary rounds of transfer, in the event that an obvious solution to a problem placement of a teacher on the priority placement list exists, the Board, may invoke the provisions of Article 22 – Board-Initiated Transfer - to accomplish same.

TRANSFER OF TEACHERS. Transfer of teachers from one Building to another shall be made by the Superintendent assisted by his/her Administrative Staff and Building Principals.
TRANSFER OF TEACHERS. 11.01 The transfer of all teachers within the system shall take place during the period April 1 to the last teaching day, specifically:
(i) Voluntary transfers shall occur from May 15 to June 25.
(ii) Forced Transfers shall occur by the last teaching day where possible.
(iii) All one year unfilled positions that may become available in any school year shall only appear on the second and the third voluntary transfer list and all permanent and probationary teachers shall have the right to apply for transfer to any such one (1) year unfilled positions that appear on such lists. Those teachers transferring into such positions, at the end of the school year, shall revert to their former positions. In the event their former positions have been phased out, they shall be returned to the position they would have held had they not taken the one
(1) year position pursuant to this Article 11.
TRANSFER OF TEACHERS. 13.01 Except as provided for in Article 12 – Security of Position, the Director of Human Resources may transfer teachers from one school to another only by mutual agreement of the teacher and the Director of Human Resources.
13.02 Transfers necessitated by Article 12 – Security of Position shall be completed before voluntary transfers are considered.
13.03 Teachers desiring a transfer shall submit an application in writing to the Director of Human Resources according to the time frame described in the posting or advertisement.
13.04 There shall be at least two (2) rounds of transfers up to June 25th. Where there is mutual agreement of the parties to this Agreement, it may be declared that the transfer period be concluded before June 25th. Where there are no internal applicants for the posted positions, the transfer period shall be considered concluded for those positions.
13.05 Teachers who request a transfer to any of the available positions shall be accommodated on the basis of system seniority, if qualified. Notwithstanding system seniority, regional seniority as per clause 13.10 (c) shall prevail within a region before a transfer has been accommodated for the whole system.
13.06 Teachers who are transferred after the last day of the summer break shall be granted a reasonable time as determined by the Board, free from teaching and/or supervisory duties, without loss of salary or benefits in order to effect the transfer.
13.07 The Director of Human Resources and/or his/her designate shall meet with the President of CSANE or his/her designate to discuss all Board initiated transfers and the opportunity shall be given to both parties to make mutually agreed alterations.
13.08 Where a surplus teacher has not been placed and prior to the Director of Human Resources recommending a Board initiated transfer, the Director of Human Resources:
(a) shall contact the teacher and arrange a mutually agreed upon consultation meeting date(s);
(b) said meeting dates shall be within five (5) working days of the initial contact;
(c) the consultation meetings shall be in person;
(d) the teacher’s wishes, place of residence, academic qualifications and past transfer record shall be given due consideration.

Transfer shall mean the movement of a teacher from one building to another building, or from one classroom teaching assignment to another within the same building, or from classroom teaching to any other position within the unit other than classroom teaching, or the reverse, or from non-classroom teaching to non- classroom teaching for regular education to special education or the reverse. Necessary and reasonable assignment changes for teachers who are normally assigned to more than one building, such as speech therapists and elementary art, music, and physical education teachers, etc. shall not be deemed transfers.
B. Any teacher who possesses the appropriate certification may apply and be interviewed for the position. The interview will be held between the teacher and the appropriate administrator(s).
C. The district has the right to employ long-term substitute teachers however, such placement shall not continue past the conclusion of the current school year, with the exception of a teacher on leave.
D. If a laid off teacher has the appropriate certification and has an evaluation of at least effective, he/she may be considered for recall.
E. For those transferees who assume the position at the end of the school year, they shall be considered in that position(s) without prejudice for all other provisions of the contract.
F. In all instances, if there is not a laid off teacher on the recall list with the appropriate certification the identified teacher for transfer may assume the vacated position immediately.

1) All positions, which become vacant on a permanent basis after the start of the school year but prior to January 15, shall be posted for immediate transfer and effective for the next semester/trimester. Positions that become available after January 15 but prior to the end of the school year shall be posted for transfer to be effective for the following school year. Any teacher who possesses the appropriate certification may apply and be interviewed for any position posted for transfer. During the summer, all jobs will be posted for transfer for the beginning of the next school year. Any teacher who possesses the appropriate certification may apply and be interviewed for any position posted for transfer. The district has the right to employ long-term substitute teachers in any vacancy which occurs after January 15 of the current school year. 2) Teachers currently working shall be afforded the opportunity to transfer to other work locations before the employment of new personnel.
3) If a laid off teacher on the recall list has the appropriate certification and is interested in a vacant position, such laid off teacher will be recalled for the remainder of the current semester/trimester and the teacher identified for transfer would then assume the vacant position the following semester/trimester.
4) In the Elementary, the initial transferee shall move no later than the end of the semester/trimester in which the vacancy occurs. Subsequent transferees shall move at the end of the school year. For those transferees who assume the position at the end of the school year, they shall be considered in that position(s) without prejudice for all other provisions of the contract.

TRANSFER OF TEACHERS. 1. Teacher Request: Teachers who desire to transfer to another school shall file a written statement of such desire with their principal and the Superintendent. When a position becomes available the Superintendent shall give first consideration to teachers according to years of experience, educational qualifications and teacher evaluations. If the request is not granted, the Superintendent shall give a written response to the teacher stating reasons for the denial within seven (7) working days of denial.

TRANSFER OF TEACHERS. 10.01 Any transfer of a Teacher among the high schools in Fort Xxxxxxx, Rainy River and Atikokan shall occur only if notice is given in writing to the Teacher involved prior to May 1 of the preceding school year except when the transfer is by mutual agreement between the Board and the Teacher.
10.02 Transfers will be based on demonstrated educational need and shall not create a surplus in the school to which the transferee is assigned. With due consideration being given to the program needs, the transferee would be the most junior Teacher as qualified under the Regulation - Operation of Schools - General.
10.03 Where, at the request of the Board, a Teacher is transferred , the Board will bear the cost of moving subject to the conditions as outlined in Board policy.
10.04 This clause (10.03) will not apply in cases of redundancy.
TRANSFER OF TEACHERS. 13.01 A teacher may be transferred to a comparable position within the same community when it is deemed necessary but shall not be transferred from one community to another without the teacher’s consent.
13.02 Any transfer may be made with the mutual agreement of the School Board and the teacher.
