Determination of the Participation Tier. 1. On July 1, 2022, as extended by written agreement of the Settling Distributors and the Enforcement Committee, provided that Settling Distributors determine to proceed with this Agreement, the Settlement Fund Administrator shall determine the Participation Tier. The criteria used to determine the Participation Tier are set forth in Exhibit H. Any disputes as to the determination of the Participation Tier shall be decided by the National Arbitration Panel.
