Common use of DEVELOPER SHALL NOT MORTGAGE OR CREATE A CHARGE Clause in Contracts

DEVELOPER SHALL NOT MORTGAGE OR CREATE A CHARGE. After the Developer executes this Agreement, it shall not mortgage or create a charge on the Apartment /project land and if any such mortgage or charge is made or created then notwithstanding anything contained in any other law for the time being in force, such mortgage or charge shall not affect the right and interest of the Allottee/s who has taken or agreed to take such Apartment.

DEVELOPER SHALL NOT MORTGAGE OR CREATE A CHARGE. After the Developer executes this AgreementAgreement save and except as may be required to obtain construction finance, it the Developer shall not mortgage or create a charge on the said Apartment /project land and if any such mortgage or charge is made or created then notwithstanding anything contained in any other law for the time being in force, such mortgage or charge shall not affect the right and interest of the Allottee/s Allottee who has taken or agreed to take such Apartment.

DEVELOPER SHALL NOT MORTGAGE OR CREATE A CHARGE. After the Developer executes this Agreement, it Agreement he shall not mortgage or create a charge on the Designated Apartment /project land and if any such mortgage or charge is made or created then notwithstanding anything any contained in any other law for the time being in force, such mortgage or charge shall not affect the right and interest of the Allottee/s Allottee who has taken or agreed to take such Designated Apartment.

DEVELOPER SHALL NOT MORTGAGE OR CREATE A CHARGE. After the Developer executes this Agreementagreement, it shall not mortgage or create a charge on the Apartment /project land flat which is a subject matter of this agreement, and if any such mortgage or charge is made or created created, then notwithstanding anything contained in any other law for the time being in force, such mortgage or charge shall not affect the right and interest of the Allottee/s Purchaser who has taken or agreed to take such Apartment.

After the Developer executes this Agreement, it Agreement he shall not mortgage or create a charge on the Apartment /project land Apartment, and if any such mortgage or charge is made or created then notwithstanding anything contained in any other law for the time being in force, such mortgage or charge shall not affect the right and interest of the Allottee/s Allottee who has taken or agreed to take such ApartmentApartment / Building.

DEVELOPER SHALL NOT MORTGAGE OR CREATE A CHARGE. After the Developer executes this Agreement, it shall not mortgage or create a charge on the Apartment /project land Unit/Building/Plot and if any such mortgage or charge is made or created then notwithstanding anything contained in any other law for the time being in force, such mortgage or charge shall not affect the right and interest of the Allottee/s who has taken or agreed to take such ApartmentUnit.

After the Developer executes this Agreement, it Agreement he shall not mortgage or create a charge on the Apartment /project land Bungalow and if any such mortgage or charge is made or created then notwithstanding anything contained in any other law for the time being in force, such mortgage or charge shall not affect the right and interest of the Allottee/s Allottee who has taken or agreed to take such ApartmentBungalow.
