Development Plans and Reports Clause Samples
Development Plans and Reports. NILE agrees to provide MAYO with the Reports semi-annually, within 30 days of June 30th and December 31st, starting in the second License Year. Such Reports shall be in sufficient detail for MAYO to among other things:
(a) determine whether NILE is using Reasonable Commercial Efforts to pursue the regulatory approvals;
(b) determine whether NILE is using Reasonable Commercial Efforts to develop a Development plan; and
(c) determine whether a Development plan, once developed and implemented, establishes that NILE is using its Reasonable Commercial Efforts for Commercialization of a Product.
Development Plans and Reports. NILE agrees to provide MAYO with Reports semi-annually, within thirty (30) days of June 30th and December 31st of each calendar year during the Term hereof.
Development Plans and Reports. Exhibit A presents ACCENTIA’s detailed plan for Development and Commercialization of an FDA Product and Accentia / Mayo Execution Copy 10 February 2004 projected performance milestones for accomplishing its plan. ACCENTIA also agrees to provide MAYO with Reports on or before May 1 and November 1 of each License Year. Such Reports shall be in sufficient detail for MAYO to determine whether ACCENTIA is using best efforts to pursue the Regulatory Approvals and to protect the rights to Marketing Exclusivity, and to determine whether ACCENTIA is using its best efforts for Commercialization of an FDA Product.
