Common use of Difficulty to Ascertain or Locate Clause in Contracts

Difficulty to Ascertain or Locate. If it is impossible or difficult to ascertain the person who is entitled to receive any benefit under the Plan, the Administrator in its discretion may direct that such benefit be (a) paid to another person in order to carry out the Plan's purposes; or (b) retained in the Trust; or (c) paid to a court pending judicial determination of the right thereto.
