Common use of Direct damage Clause in Contracts

Direct damage. Except in respect of liability under clauses 22, 26.8, 26.11 and 26.12, each party (and its officers, employees and agents) will be liable under or in connection with this agreement (whether in contract, tort (including negligence) or otherwise) to the other party for only direct damage to the physical property of any person ("Direct Damage") that results from a breach of this agreement, negligence, or failure to exercise Good Electricity Industry Practice.

Direct damage. Except in respect of liability under clauses 2222.3, 26.8, 26.11 26.11, and 26.12, each party (and its officers, employees and agents) will be liable under or in connection with this agreement (whether in contract, tort (including negligence) or otherwise) to the other party for only direct damage to the physical property of any person ("Direct Damage") that results from a breach of this agreement, negligence, or failure to exercise Good Electricity Industry Practice.

Except in respect of relation to liability under clauses 2226.10, 26.826.15, 26.11 26.16(b), 26.17, 26.18(b) and 26.1227.3, each party (and its officers, employees and agents) will be liable under or in connection with this agreement (whether in contract, tort (including negligence) or otherwise) to the other party only for only direct damage to the physical property of any person ("Direct Damage") that results from a breach of this agreement, negligence, or failure to exercise Good Electricity Industry Practice.

Direct damage. Except as expressly provided in respect of liability under clauses 2222.3, 26.826.9, 26.11 26.11, 26.12 and 26.12, 27.3 each party (and its respective officers, employees and or agents) will only be liable under or in connection with this agreement (whether in contract, tort (including negligence) or otherwise) to the other party under this agreement or otherwise arising from the relationship between them for only any direct loss to or damage to the physical property of any person ("together “Direct Damage"”) that where the Direct Damage results from a the breach of this agreement, negligence, negligence or failure to exercise use Good Electricity Industry PracticePractice by the first party or any of its officers, employees, agents or invitees.
