Common use of Discharged Rights Clause in Contracts

Discharged Rights. and Obligations shall not include, -------------- and there shall be no termination or release pursuant to this Section 9.11 of ------------ (i) any rights or obligations arising pursuant to any of the Financing Documents in respect of the period or in respect of payments hereunder made during the period prior to the effective date of the relevant Substitution Agreement or, (ii) any rights or obligations relating to the payment of any amount which has fallen due and not been paid hereunder prior to such effective date or rights or obligations for the payment of interest, damages or other amounts becoming due hereunder as a result of such nonpayment.
