Disciplinary Material. Disciplinary material shall be removed from the file after six (6) years if there has been no recurrence of the problem or at any time upon mutual agreement between the academic employee and the immediate supervisor, except for applications of
Disciplinary Material. Any disciplinary material placed in the personnel file shall be signed by the teacher which shall only signify receipt of a copy of the document and not agreement with the content. Unless a member is disciplined for the same offense, after 5 years, written references to verbal warnings and written warnings will not be used in the application of progressive discipline. In the event a member is disciplined for the same offense, any previous discipline shall remain in the personnel file until the most recent discipline is eligible for removal if applicable.

The 72 hour notice will be waived in the event the District is directed by an outside agency (law enforcement, auditor) to refrain from notifying the employee.

4. The educator shall be permitted to attach his or her comments related to the information.

If the employee received similar disciplinary material during the 24 months, such disciplinary material shall remain in the employee's personnel file until the expiration of a 24-month period in which the employee receives no similar disciplinary material. Negative material directly related to discipline or re-employment shall not be placed in an employee's personnel file unless the educator is provided a copy and has a conference with the administrator initiating the negative material. If the Board determines that it is in the best interests of the District to do so, the Board may expunge from an educator's personnel file those disciplinary reports, letters of reprimand, records of disciplinary action, or performance evaluations which are more than six (6) years old.
