Disclaimer of Cargo Liability. Pactiv is not a carrier and Pactiv’s sole obligation under this Agreement is the management of certain of Xxxxxxxx’ transportation requirements for the efficient shipment of Xxxxxxxx’x Freight. Xxxxxxxx therefore releases and agrees to hold harmless and defend Pactiv from any and all liability for cargo loss, damage or destruction claims arising out of the shipment of Xxxxxxxx’x Freight.
