Common use of DISCLAIMER OF RESPONSIBILITY Clause in Contracts

DISCLAIMER OF RESPONSIBILITY. Notwithstanding anything to the contrary in this agreement contained: 14.1 The LANDLORD shall not under any circumstances be liable for any damage to or loss of any property to whomsoever it may belong which is upon the PREMISES or any injury to any person who might at any time be upon the PREMISES and the TENANT hereby accepts responsibility for and indemnifies the LANDLORD and her employees or agents against any claim by any person in respect of any such damage, loss or injury. 14.2 The TENANT hereby acknowledges that the TENANT shall not under any circumstances have any claim or right of action whatsoever against the LANDLORD for damages, loss or otherwise, nor be entitled to withhold or defer payment of rent by reason of the PREMISES being in defective condition or falling into disrepair.
