Disclosure of Commerce’s Liability for Failure to Make Transfers. If we do not complete a transfer to or from your Card on time or in the correct amount according to our Agreement with you, we will be liable for your losses or damages. However, we will not be held liable for and you will be responsible for all fees in connection with the following: • If, through no fault of ours, you do not have enough money stored on your Card to make the transaction. • If the ATM where you are making the transfer does not have enough cash. • If the terminal or system was not working properly and you knew about the breakdown prior to completing the transaction. • If circumstances beyond our control (such as flood or fire) prevent the transfer, despite reasonable precautions that we have taken.
