Common use of Disclosure of Supplier’s information Clause in Contracts

Disclosure of Supplier’s information. (a) Subject to clause 9.2(b), the School Council agrees to treat as confidential all information of or relating to the Supplier that is provided to it, whether under this Agreement or the Tender Documentation, by or on behalf of the Supplier and which is identified in writing by the Supplier as confidential. (b) The Supplier consents to the School Council publishing or otherwise making available information in relation to the Supplier and the provision of the Goods as may be required:‌ (i) in order to comply with the requirements of the Contract Publishing System; (ii) to other Victorian Government departments and agencies or Ministers of the State of Victoria in connection with the use of the Goods; (iii) to any public sector agency (of the State, any other state or territory or the Commonwealth) for the purposes of benchmarking, provided that it will not identify the Supplier; (iv) by the office of the Auditor General appointed under section 94A of the Constitution Xxx 0000 (Vic) (Auditor-General) or the ombudsman appointed under the Xxxxxxxxx Xxx 0000 (Xxx) (Ombudsman); (v) to comply with Law, including the Freedom of Information Xxx 0000 (Vic); or (vi) to the IBAC.
