Unless otherwise provided under the HITECH Act, Business Associate must have available for Company Covered Entity the disclosure information required by Agreement Section C.3(a) this Agreement, Section 4.3.1 for the sixsix (6) years preceding Covered Entity’s request for the disclosure information.

In addition, where Business Associate is contacted directly by an individual based on information provided to the individual by Company, and where so required by the HITECH Act and/or any accompanying regulations, Business Associate shall make such Disclosure Information available directly to the individual.
