Common use of Displacement by Reinstatement of Another to His Clause in Contracts

Displacement by Reinstatement of Another to His. Her Former Position Any employee, though he or she may have attained permanent status and who is displaced as a result of another employee's being returned to his or her former position under paragraph A.5 above or under this subsection, shall likewise be reinstated to his/her former position. If an employee so affected has permanent status but no former position he or she shall be placed on the appropriate layoff list. Any employee who has permanent or probationary status and who is displaced or placed on layoff in accordance with this subsection, without fault or delinquency on his/her part, shall be reinstated to the position from which he/she was displaced if within three (3) years a vacancy should occur within that classification. (BMC 2-1-512).
