Disposal Costs. DPT reserves the right to invoice COMPANY for all disposal costs, related to manufacture of the Products, unless the disposal relates to a Rejected Product causes by the failure of DPT to follow established written procedures.

Disposal Costs. Seller shall be responsible for and shall pay for all storage, transport, alternate use, or disposal of any rejected Shipment or partial Shipment; provided, that Buyer shall segregate and safeguard for Seller’s account any rejected Shipment. Seller shall indemnify Buyer and hold Buyer harmless in respect of all liabilities, losses, costs, and expenses suffered and incurred by Buyer in respect of storage, transport and disposal of any rejected Shipment.

Disposal Costs. All property of the Concession Contractor not removed from the area in accordance with the terms of this Concession Contract shall be considered abandoned property. Such abandoned property shall be subject to disposition or disposal by Reclamation, and the Concession Contractor agrees to pay the costs of this disposition or disposal. A failure by the Concession Contractor to pay such costs will result in the full amount being offset, to the full extent allowable under applicable law, against any other payments owed by the United States to the Concession Contractor or its parent company or other related entities.
