Common use of Disposal Proceeds Clause in Contracts

Disposal Proceeds. If any Disposal Proceeds are required to be applied in mandatory prepayment of the Senior Facility Liabilities and/or Bond Liabilities then those Disposal Proceeds shall be applied in or towards Payment of the Senior Facility Liabilities and/or Bond Liabilities in accordance with the terms of the Senior Facilities Agreement, and/or Bond Terms (as applicable) and the consent of any other Party shall not be required for that application.

Disposal Proceeds. If any Disposal Proceeds are required to be applied in mandatory prepayment of the Senior Facility Facilities Liabilities and/or Bond Liabilities then then, subject to Clause 13.6 (Adjustment of Mandatory Prepayments), those Disposal Proceeds shall be applied in or towards Payment of the Senior Facility Facilities Liabilities and/or Bond Liabilities requiring that application and shall be applied in accordance with the terms of the Senior Facilities Agreement, and/or Bond Terms Finance Documents (as applicable) and the consent of any other Party shall not be required for that application).

Disposal Proceeds. If any Disposal Proceeds are required to be applied in mandatory prepayment of the Super Senior Facility Liabilities and/or Bond or the Senior Secured Liabilities then those Disposal Proceeds shall be applied in or towards Payment of the Senior Facility Liabilities and/or Bond Liabilities in accordance with the terms of the Senior Facilities Agreement, and/or Bond Terms (as applicable) Debt Documents and the consent of any other Party shall not be required for that application.

Disposal Proceeds. If any Disposal Proceeds (in respect of a Non-Distressed Disposal) are required to be applied in mandatory prepayment of any of the Senior Facility Liabilities and/or Bond Liabilities then those such Disposal Proceeds shall be applied in or towards Payment of the such Senior Facility Liabilities and/or Bond Liabilities in accordance with the terms of the Senior Facilities Agreement, and/or Bond Terms (as applicable) Facility Finance Documents and the consent of any other Party shall not be required for that application.

If any Disposal Proceeds are required to be applied in mandatory prepayment of the Senior Facility Liabilities and/or Bond Liabilities then in accordance with the terms of the Facilities Agreement then, subject to Clause 14.4 (Adjustment of Mandatory Prepayments), those Disposal Proceeds shall be applied in or towards Payment of the Senior Facility Liabilities and/or Bond Liabilities in accordance with the terms of the Senior Facilities Agreement, and/or Bond Terms (as applicable) Agreement and the consent of any other Party shall not be required for that application.
