Disposition of resources. An investor-owned transmission and distribution utility shall sell capacity resources, energy or renewable energy credits purchased pursuant to subsection 3 or take other action relative to such capacity resources, energy or renewable energy credits as directed by the commission. Disposition of resources. In South Dakota, cultural materials recovered from private lands, except for human remains and associated grave goods, are the property of the private landowner(s). If a landowner does not wish to take possession of any cultural materials recovered, upon request of a tribe(s) or the lead tribal monitor on behalf of any tribe(s), Xxxxxxxxx will consult with the landowner to procure a Gift Agreement with the respective tribe(s). If such an agreement can be obtained, the artifacts and associated documentation will then be turned over to such tribe(s). In the event that the lead tribal monitor does not request possession of the artifacts on behalf of any tribe(s), or a tribe(s) does not directly make such request, then said artifacts may be returned as closely as possible to where they were discovered or be curated at the South Dakota Archaeological Research Center in Rapid City, South Dakota. To the extent that artifacts require curation in accordance with this plan, Xxxxxxxxx will be responsible for the associated curation costs and expenses. If the Xxxxxxxxx Wind Project Unanticipated Discovery Plan Page 6 artifacts are returned to the site, they will be reburied, and the location documented by Xxxxx & XxXxxxxxx archaeologist (under the direction of Xxxxxxxxx) with a GPS, and a report of such location(s) will be provided by Xxxxxxxxx to WAPA, SDSHPO, and the lead tribal monitor to provide to the respective THPOs.   • Nature of Return or Disposition Disposition shall be by destruction or deletion of data. Return shall be by a transfer of data. The data shall be transferred to the following site as follows:

  • Disposition The HSP will not, without the LHIN’s prior written consent, sell, lease or otherwise dispose of any assets purchased with Funding, the cost of which exceeded $25,000 at the time of purchase.

  • Access To, Return, and Disposition of Data Upon written request of LEA, Operator shall dispose of or delete all Data obtained under the Service Agreement when it is no longer needed for the purpose for which it was obtained, and transfer said data to LEA or LEA’s designee within sixty (60) days of the date of termination and according to a schedule and procedure as the Parties may reasonably agree. Operator acknowledges LEA’s obligations regarding retention of governmental data, and shall not destroy Data except as permitted by LEA. Nothing in the Service Agreement shall authorize Operator to maintain Data obtained under the Service Agreement beyond the time period reasonably needed to complete the disposition. Disposition shall include (1) the shredding of any hard copies of any Data; (2) Data Destruction; or (3) Otherwise modifying the personal information in those records to make it unreadable or indecipherable. Operator shall provide written notification to LEA when the Data has been disposed of. The duty to dispose of Data shall not extend to data that has been de-identified or placed in a separate Student account, pursuant to the other terms of the DPA. The LEA may employ a “Request for Return or Deletion of Data” FORM, a sample of this form is attached on Exhibit “D”). Upon receipt of a request from the LEA, the Operator will immediately provide the LEA with any specified portion of the Data within five (5) business days of receipt of said request.

  • Development or Offering of Renewable Energy Sources Competitive Supplier agrees that it will comply with the applicable provisions of X.X.X. x. 00X, § 00X, § 00 F1/2, and any regulations, orders or policies adopted pursuant thereto.

  • Extent of Return or Disposition Return or Disposition is partial. The categories of data to be disposed of are set forth below or are found in an attachment to this Directive: Return or Disposition is Complete. Disposition extends to all categories of data.

  • RIGHTS OF MANAGEMENT Any rights of management which are not specifically mentioned in this Agreement and are not contrary to its intention shall continue in full force and effect for the duration of this contract, always provided that in the exercise of the aforementioned management rights there shall be no discrimination.
