Common use of Disposition or Sale Clause in Contracts

Disposition or Sale. Except for animals and property removed after the death of the Resident, Landlord may throw away or donate to a charitable organization all items of personal property that are: (1) left in the apartment after surrender or abandonment; or (2) left outside more than 1 hour after an order of restitution or writ of possession is executed following an eviction. Animals removed after surrender, abandonment, or eviction may be kenneled or turned over to local authorities or humane societies. Property not thrown away or donated may be disposed of by sale, which must be held no sooner than 30 days after written notice of date, time, and place of sale is sent by both regular mail and certified mail (return receipt requested) to Resident’s last known address. The notice must itemize the amounts owed, list the name, address, and phone number of the person to contact about sale, and note Resident’s right to redeem property. The sale may be public or private, is subject to any third-party ownership or lien claims, must be to the highest cash bidder, and may be in bulk, in batches, or item by item.
