Common use of Distribution Company Liability Clause in Contracts

Distribution Company Liability. Notwithstanding anything herein to the contrary, Distribution Company’s liability for any payments made to Owner pursuant to Sections 3.3.4, 3.4, 14.3, and 14.5 shall not exceed, in aggregate, the Proportionate Share multiplied by One Hundred Twenty Million Dollars ($120,000,000).
