Common use of Distributions for a Designated Beneficiary Clause in Contracts

Distributions for a Designated Beneficiary. During the lifetime of a Designated Beneficiary, the Trustee shall use, apply or expend as much of the net income and principal of the Trust Account for the supplemental needs of the Designated Beneficiary of the Trust Account as the Trustee, in its sole and absolute discretion, deems appropriate. This trust is intended to conform to the provisions of section 7-1.12 of the New York Estates, Powers and Trusts Law. This trust shall supplement, and not replace, impair or diminish the Designated Beneficiary’s eligibility for benefits or assistance of any federal, state, county, city, or other governmental entity. The income and principal of the trust shall be used to provide goods and services that enhance a Designated Beneficiary’s quality of life, and which are not otherwise provided for or covered, payable or reimbursable by any government benefit program and shall not be considered an available resource.
