DISTRIBUTIONS FROM THE OPERATING FUND. During any period in which the Owner is required by notice from OHCS to establish and maintain an Operating Fund, neither the Owner nor those having a beneficial interest in the Owner will make, receive, or retain any distribution of any assets or any income of any kind from the Project for the term of this Agreement except from the Operating Fund and then only subject to the following conditions:
