Common use of District Responding to Request Clause in Contracts

District Responding to Request. (s) for Clarification(s) The District is not obligated to respond to any questions or requests for clarifications that the District judges, in the exercise of its sole and absolute discretion: (1) are received after the above-specified deadline; (2) are submitted in a manner other than as required by the RFQ Documents; (3) are unintelligible; (4) seek information that is irrelevant to the subject matter of the RFQ; (5) seek information that is already contained in the RFQ; or (6) involve weaknesses, errors or omissions in a SOQ, whether observed or not observed by the District, it being the intent of the District that all such weaknesses, errors or omissions, whether observed or not observed, are the sole responsibility of the Applicant. Should the District determine to respond to a Request for Clarification(s), the District will do so by way of a written Addendum. No verbal RFCs will be responded to. No verbal Responses to RFCs shall be relied on by any Applicant/Proposer.
