Common use of Documentation Prior to Payment Clause in Contracts

Documentation Prior to Payment. Neither the final payment, nor payment of any remaining retained percentage will be made to Construction Manager until it submits to Owner: a. A sworn or notarized affidavit that all payrolls, bills for materials and equipment, all charges by Construction Managers and Subcontractors and other indebtedness connected with the Work for which Owner and its property might in any way be responsible, have been paid or otherwise satisfied; b. Consent to final payment by Construction Manager's Surety Company; and c. All other data required by Owner establishing payment or satisfaction of all such obligations, including, but not limited to, close-out documentation, receipts, releases, and waivers of lien arising out of and required under the Agreement. d. All other data required by the third party auditor.
