12.4.4 Notwithstanding anything to the contrary herein contained, a written notice or communication actually received by a party shall be an adequate written notice or communication to it notwithstanding that it was not sent to or delivered at its chosen domicilium citandi et executandi.
12.4.5 . For the purposes of this Deed clause, notices shall include any notice in the form of Salea data message as defined in the Electronic communications and Transactions Act, "business day"25 of 2002.
17.4 All notices made by any Party to the other (“the addressee”) which:
17.5 is delivered by hand during the Normal Business Hours of the addressee at the addressee’s domicilium shall be deemed, means unless the contrary is proven by the addressee, to have been received by the addressee at the time of delivery;
17.6 is posted by prepaid registered post from an address within the Republic of South Africa to the addressee at the addressee’s domicilium shall be deemed, unless the contrary is proven by the addressee, to have been received by the addressee on the 10th day after the date of posting;
17.7 Notwithstanding anything contained to the contrary in this MSA, any day notice written or otherwise actually received by one Party from the other than a SaturdayParty shall be adequate notice to such Party, Sunday or public holidayunless otherwise required by any provision of this MSA.
17.8 The Customer hereby consents in the event of any legal action being instituted by FirstWord against it, it hereby consents to the jurisdiction of the Magistrate’s Court holding jurisdiction despite the fact that the amount claimed exceeds the jurisdiction of the Magistrate’s Court. Notwithstanding the contents of this clause FirstWord and Subscriber can, if it deems necessary, approach the High Court holding jurisdiction for any urgent application and also has the discretion to institute action out any High Court holding jurisdiction.

12.4.3 sent by e15 MORE THAN ONE PURCHASER In the event of the PURCHASER to this Agreement being more than one person, then in such event all purchasers shall be jointly and severally be liable in solidum and as co-mail principal debtors together with the PURCHASER for all the liabilities and obligations arising for the PURCHASER from this Agreement, and no such party shall be entitled to its chosen e-mail address stipulated aboveany defence or exception of any nature which would otherwise have been available to him in order to evade or in any manner reduce the strict effect and provisions of this clause. 16 JURISDICTION For purpose of any action, interdict or other form or litigation which might arise from this Agreement or form of application or which might result therefrom, the parties hereto agree to the jurisdiction of the Magistrate's Court for the district of WINDHOEK notwithstanding the fact that such aforesaid Court might otherwise not have possessed jurisdiction in such matter. 12.4.4 Magistrate's Courts Act No. 33 of 1945, as amended. Notwithstanding anything contained to the contrary herein contained, a written notice the SELLER shall at all times reserve the right for himself to demand that any action brought by himself or communication actually received by a party shall the PURCHASER be an adequate written notice or communication to it notwithstanding that it was not sent to or delivered at its chosen domicilium citandi et executandibrought before any other Court with applicable jurisdiction.
12.4.5 For the purposes of this Deed of Sale, "business day", means any day other than a Saturday, Sunday or public holiday.

12.4 17.4. Any notice to a party –party:
12.4.1 17.4.1. sent by prepaid registered post in a correctly addressed envelope to it at an address chosen as its domicilium citandi et executandi shall be deemed to have been received on the fifth 7th business day after posting (unless the contrary is proved);
12.4.2 17.4.2. delivered by hand to a responsible person during ordinary business hours at the physical address chosen as its domicilium citandi et executandi shall be deemed to have been received on the day of delivery; or
12.4.3 17.4.3. sent by telefax or e-mail to its chosen e-mail address stipulated abovemail, shall be deemed to have been received on the first business day after date of despatch (unless the contrary is proved).. I HEREBY DECLARE THAT THE ABOVE PERSONAL PARTICULARS ARE BOTH TRUE AND CORRECT, AND THAT I UNDERSTAND THE CONTENT OF THIS MANDATE AND FEE AGREEMENT. Signed at on this the day of 20 WITNESSES:
12.4.4 Notwithstanding anything to the contrary herein contained, a written notice or communication actually received by a party shall be an adequate written notice or communication to it notwithstanding that it was not sent to or delivered at its chosen domicilium citandi et executandi.
12.4.5 For the purposes of this Deed of Sale, "business day", means any day other than a Saturday, Sunday or public holiday.2. INTENDED HUSBAND
