Common use of Don'ts Clause in Contracts

Don'ts. LICENSEE agrees that LICENSEE will not:  Act dishonestly or unprofessionally, including by posting inappropriate, inaccurate, or objectionable content;  Add content that is not intended for, or inaccurate for, a designated field (e.g. submitting an email address in the “title” or any other field, or including any personally identifiable information such as telephone numbers, street addresses etc. for which corresponding fields are not provided by the licensed programs);  Create more than one personal account, in case the LICENSEE is an individual;  Use an image or photo that does not resemble you for your profile;  Create a false identity on the licensed programs;  Misrepresent your current or previous positions and qualifications;  Misrepresent your affiliations with a person or entity, past or present;  Misrepresent your identity, including but not limited to the use of a pseudonym;  Create a profile for any real person other than yourself;  Invite people you do not know to join your network;  Tag users or send email invitations to non-users without their consent  Use or attempt to use another's account;  Harass, abuse or harm another person;  Send spam or other unwelcomed communications to others;  Scrape or copy profiles and information of others through any means (including crawlers, browser plugins and add-ons, and any other technology or manual work);  Act in an unlawful, libellous, abusive, obscene, discriminatory or otherwise objectionable manner;  Disclose information that you do not have the right to disclose (such as confidential information of others (including your employer) such as identification documents, sensitive financial information etc.);  Violate intellectual property rights of others, including patents, trademarks, trade secrets, copyrights or other proprietary rights;  Violate the intellectual property or other rights of LICENSOR, including, without limitation, using the word “PEXit” or LICENSOR’s logos in any business name, email, or URL except as authorized by LICENSOR;  Use PEXit invitations to send messages to people who do not know you or who are unlikely to recognize you as a known contact;  Post any unsolicited or unauthorized advertising, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” etc.  Send messages to distribution lists, newsgroup aliases, or group aliases;  Post anything that contains software viruses, worms, or any other harmful code;  Manipulate identifiers in order to disguise the origin of any message or post transmitted through the licensed programs;  Create profiles or provide content that promotes escort services or prostitution.  Engage in unlawful multi-level marketing such as a pyramid scheme, fraud or other similar practice;  Copy or use the information, content or data of others (including LICENSOR’s) available on the licensed programs (except as expressly authorized in the Agreement);  Copy or use the information, content or data of others (including LICENSOR’s) available on the licensed programs in connection with a competitive service;  Copy, modify or create derivative works of the licensed programs, or any related technology (except as expressly authorized under the Agreement);  Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code of the licensed programs or any related technology, or any part thereof;  Imply or state that you are affiliated with or endorsed by LICENSOR without LICENSOR’s express consent (e.g., representing yourself as an accredited LICENSOR’s trainer);  Rent, lease, loan, trade, sell/re-sell access to the licensed programs or any content or information from the licensed programs;  Sell, sponsor, or otherwise monetize a Group or any other feature of the licensed programs, without LICENSOR’s consent;  Deep-link to the licensed programs for any purpose other than to promote your profile or a Group on the licensed programs, without LICENSOR's consent;  Remove any copyright, trademark or other proprietary rights notices contained in or on the licensed programs;  Remove, cover or obscure any advertisement included in the licensed programs;  Collect, use, copy, or transfer any information obtained from the licensed programs, excepting as permitted by the license agreement, without the consent of LICENSOR;  Share or disclose information of others without their express consent;  Use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” the licensed programs or any related data or information;  Use bots or other automated methods to access the licensed programs, add or download contacts, send or redirect messages;  Monitor the availability, performance or functionality of the licensed programs for any competitive purpose;  Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the licensed programs;  Access the licensed programs except through the interfaces expressly provided by LICENSOR, such as its mobile applications and xxxxx.xxx;  Override any security feature of the licensed programs; and/or

 Post • Upload and/or post anything that contains software viruses, worms, or any other harmful code;  Manipulate identifiers in order to disguise the origin of any message or post transmitted through the licensed programs;  • Create profiles accounts or provide content that promotes escort services or prostitution.  Engage in unlawful multi-level marketing such as • Create or operate a pyramid scheme, fraud or other similar practice;  Copy • Purchase, use, or use access the information, content Services for building a competitive product or data of others service or for any other competitive purposes (including LICENSOR’s) available on the licensed programs (except as expressly authorized in the Agreementdetermined by JuJi);  Copy • Misuse the Services by interfering with their normal operation, or use attempting to access them using a method other than through the informationinterfaces and instructions that we provide. • Circumvent or attempt to circumvent any limitations that Juji imposes on your account (such as by opening up a new account to create a chat/interview that we have closed for a Terms violation). • Unless authorized by Juji in writing, content you may not probe, scan, or data test the vulnerability of others (including LICENSOR’s) available on the licensed programs in connection with a competitive service;  any Juji system or network. • Copy, modify or create derivative works of Juji, the licensed programs, Services or any related technology (except as expressly authorized under the Agreementby Juji);  • Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code of for the licensed programs Services or any related technology, or any part thereof;  • Imply or state that you are affiliated with or endorsed by LICENSOR Juji without LICENSOR’s our express consent (e.g., representing yourself as an accredited LICENSOR’s trainera Juji employee);  Rent, lease, loan, trade, sell/re-sell access to the licensed programs or any content or information from the licensed programs;  Sell, sponsor, or otherwise monetize a Group or any other feature of the licensed programs, without LICENSOR’s consent;  • Remove, cover or obscure any advertisement information included in as part of the licensed programsServices;  • Collect, use, copy, or transfer any information obtained from the licensed programs, excepting as permitted by the license agreement, Services without the consent of LICENSORour consent;  • Share or disclose information of others without their express consent;  • Use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” the licensed programs Services or any related data or information;  • Use bots or other automated methods to access the licensed programsServices, add or download contactsincluding but not limited to the creation of fake accounts, send or redirect messagesadding and uploading information, and downloading and distributing the information offered by the Services;  • Imply or state that you are affiliated with or endorsed by LICENSOR LinkedIn without LICENSOR’s our express consent (e.g., representing yourself as an accredited LICENSOR’s LinkedIn trainer);  • Rent, lease, loan, trade, sell/re-sell access to the licensed programs Services or related any content information or information from the licensed programsdata;  • Sell, sponsor, or otherwise monetize a LinkedIn Group or any other feature of the licensed programsServices, without LICENSOR’s LinkedIn's consent;  • Deep-link to the licensed programs our Services for any purpose other than to promote your profile or a Group on LinkedIn (as set forth in the licensed programsBrand Guidelines), without LICENSORLinkedIn's consent;  Use PEXit invitations to send messages to people who do not know you or who are unlikely to recognize you as a known contact;  Post any unsolicited or unauthorized advertising, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” etc.  or any other form of solicitation unauthorized by WorkMerk; Send messages to distribution lists, newsgroup aliases, or group aliases;  Post anything that contains software viruses, worms, or any other harmful code;  Manipulate identifiers in order to disguise the origin of any message or post transmitted through the licensed programsServices;  Create profiles or provide content that promotes escort services or services, pandering, and/or prostitution.  Engage in unlawful multi-level marketing such as Creating or operate a pyramid scheme, fraud or other similar practice;  Copy or use the information, content or data of others (including LICENSOR’s) available on the licensed programs Services (except as expressly authorized in the Agreementauthorized);  Copy or use the information, content or data of others (including LICENSOR’s) available on the licensed programs WorkMerk in connection with a competitive serviceservice (as determined by WorkMerk);  Copy, modify or create derivative works of WorkMerk, the licensed programs, Services or any related technology (except as expressly authorized under the Agreementby WorkMerk);  Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code of for the licensed programs Services or any related technology, or any part thereof;  Imply or state that you are affiliated with or endorsed by LICENSOR WorkMerk without LICENSOR’s our express consent (e.g., representing yourself as an accredited LICENSOR’s WorkMerk trainer);  Rent, lease, loan, trade, sell/re-sell access to the licensed programs Services or related any content information or information from the licensed programsdata;  Sell, sponsor, or otherwise monetize a WorkMerk Group or any other feature of the licensed programsServices, without LICENSOR’s WorkMerk's consent;  Deep-link to the licensed programs our Services for any purpose other than to promote your profile or a Group on WorkMerk (as set forth in the licensed programsBrand Guidelines), without LICENSORWorkMerk's consent;  Remove any copyright, trademark or other proprietary rights notices contained in or on the licensed programsour Service;  Remove, cover or obscure any advertisement included in on the licensed programsServices;  Collect, use, copy, or transfer any information obtained from the licensed programs, excepting as permitted by the license agreement, WorkMerk without the consent of LICENSORWorkMerk;  Share or disclose information of others without their express consent;  Use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” the licensed programs Services or any related data or information;  Use bots or other automated methods to access the licensed programsServices, add or download contacts, send or redirect messages;  Monitor the Services' availability, performance or functionality of the licensed programs for any competitive purpose;  Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the licensed programsServices;  Access the licensed programs Services except through the interfaces expressly provided by LICENSORWorkMerk, such as its mobile applications applications, XxxxXxxx.xxx and xxxxx.xxxxxxxxxxxxx.xxx;  Override any security feature of the licensed programs; and/orServices;
