Common use of DPA Counsel Clause in Contracts

DPA Counsel. The DPA may retain counsel or use staff counsel to advise the DPA regarding its rights and obligations under the Agreement. The DPA shall bear its own expenses incurred in connection with any such legal services. Legal fees incurred by the DPA and its Subcontractors in carrying out its duties hereunder shall be the responsibility of the DPA and shall not be reimbursed by the Secretary. A legal interpretation of the delegated processors statutory authority and the Section 202 Program Regulations published in the Federal Register shall be made only by HUD Counsel after reasonable consideration of the DPA’s position.
